Probate

An estate is composed of two types of assets, probate and non-probate. Probate assets pass in accordance with your Will. Non-probate assets pass outside of your Will to a designated beneficiary.

Probate is a court proceeding to transfer the probate assets of a decedent if a simpler, more direct, and less expensive method is not available. In a probate proceeding, the lead role is performed by the personal representative who liquidates decedent's assets, pays bills such as medical and funeral, and transfers property according to decedent's Will, or if no Will, according to state statutes.
